Amendments to AB 1310 will allow a judge impose a sentencing enhancement for someone who uses a gun in the course of a violent crime
SACRAMENTO, Calif., May 30, 2023 – Today Assemblyman Bill Essayli announced he will offer Floor amendments to AB 1310 to allow for sentencing enhancements for someone who uses a gun in the course of a violent crime.
“This week, every single Assemblymember will have the opportunity to vote for stronger penalties for people who use a firearm in the course of a violent crime. Each time we hear of another tragic shooting, such as in Florida over the weekend wounding 9, we hear calls for more gun laws. But more gun laws on the books do nothing if we do not punish the criminals who use guns to hurt people,” remarked Assemblyman Essayli.
“Current law has a loophole for criminals, requiring a judge to dismiss a gun violence sentencing enhancement if it will send the shooter to prison for more than 20 years. My amendments to AB 1310 will simply close this loophole and provide judicial discretion to impose greater punishment for criminals who use guns to terrorize our communities,” Asm. Essayli added.
These amendments must be taken up with AB 1310 before the Legislative House of Origin deadline this Friday, June 2.
Assemblyman Bill Essayli represents the 63rd Assembly District in the California Legislature, which includes the whole cities of Norco, Menifee, Lake Elsinore, and Canyon Lake, as well as portions of the cities of Eastvale, Riverside, and Corona.
